Welcome to Qr2Art. These Terms and Conditions ("Terms") govern your access to and use of the artistic QR code generation services ("Services") provided by Qr2Art ("we," "our," or "the Company"). By using our Services, you agree to these Terms.

1. Acceptance of Terms

By accessing or using our Services, you confirm that you are at least 13 years old or the minimum legal age in your country of residence, whichever is higher. If you are a minor but over 13 years old, you must have permission from your parents or legal guardians to use our Services.

Qr2Art offers artistic QR code generation services. We provide both a free plan and paid plans with additional features.

3. User Accounts

To access certain features of our Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account and password. Please notify us immediately if you suspect unauthorized use of your account.

4. Service Plans and Payments

4.1. Free Plan: We offer a free plan with basic functionalities.

4.2. Paid Plans: We also offer paid plans with additional features. Details of these plans can be found on our pricing page.

4.3. Payments: Payments are processed through Stripe. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

5. Intellectual Property

5.1. Ownership of Generated QR Codes: All artistic QR codes generated through our Services are the intellectual property of Qr2Art, unless otherwise specified in a written agreement.

5.2. Commercial Use: Commercial use of generated QR codes is prohibited under the free plan. Paid plan users may have additional rights as specified in their subscription plan.

5.3. Rights Assignment: In special cases and upon request, Qr2Art may consider assigning rights to specific QR codes. This requires a written agreement with Qr2Art.

6. Acceptable Use

6.1. You agree not to use our Services to:

  • Generate illegal, obscene, defamatory, threatening, pornographic, harassing, hateful, racially, or ethnically offensive content.
  • Violate third-party intellectual property rights.
  • Transmit viruses or any code of a destructive nature.
  • Interfere with or disrupt the Services or servers or networks connected to the Services.

6.2. We reserve the right to terminate or suspend your access to the Services immediately, without prior notice, for any breach of these Terms.

7. Privacy

We collect and use your personal information in accordance with our Privacy Policy, which forms part of these Terms. By using our Services, you consent to the collection and use of this information as described in the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Qr2Art shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • your use or inability to use our Services;
  • any conduct or content of any third party on the Services;
  • any content obtained from the Services; and
  • unauthorized access, use or alteration of your transmissions or content.

9. Changes to Services and Terms

We reserve the right to modify or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. We may also modify these Terms from time to time. We will notify you of any changes by posting the new Terms on this page. Changes will be effective immediately upon posting.

10. Governing Law and Dispute Resolution

10.1. These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

10.2. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the arbitration laws of Spain. The seat of arbitration shall be Madrid, Spain. The language of the arbitration shall be English.

11. General Provisions

11.1. These Terms constitute the entire agreement between you and Qr2Art regarding our Services and supersede any prior agreements.

11.2. If any provision of these Terms is deemed invalid or unenforceable, such provision shall be struck out and the remaining provisions shall be enforced.

11.3. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
